28, can we knock off a couple of quick keys here. 28. Consider and take appropriate action on an interlocal agreement with the city of Austin to transfer full responsibility and funding for the thornberry road low water crossing cip project.
>> because it has now been annexed.
>> carol joseph, t.n.r., This was one of our 1997 bond projects and we started -- we designed it and went into major litigation on some right-of-way condemnation. Since that time, the city annexed that road and they are willing to -- willing to -- willing to [indiscernible] the interho local to take on the condemnation, but the balance of our funds, $312,766 and then he will be out of this thorn berry, they will take on all of the responsibility of the case as well as building the road. Since redesigned it to allow different drainage.
>> my understanding if there are savings, they will be returned to us, if there's overage the city of Austin will take care of it. Used a nice word. I would happily second approval of item 28, any further questions by Commissioners? All in favor? That passes unanimously.
