Number 13, consider and take appropriate action on the following requests regarding the estates of row lane. A is a variance to chap kerr 82.202-d, standards of construction of streets and drainage in subdivisions of Travis County for the estates of row lane, section 2 to allow for a lot in a subdivision without frontage on to a street. That's lot 30, block f. And 13-b is approval of a construction agreement with a plat for recording in precinct 2, the estates of row lane, section 2, long form plat 88 lots, 26.452 acres, row lane, fiscal posted with Travis County and city of Pflugerville. Sewage to be provided by lake side wcid, city of Pflugerville e.t.j.
>> the variance is quite simple. We require that every lot have access to the road. The lot in question is currently occupied by a storm water detention pond. The access to that lot will be provided through another lot which was dedicated for parkland, so it has an easement. When the homeowners association can't get in and out to clean out the pond when when necessary, so it's taking care of the access. The use of the lot can only be used for the storm water. The access they need to the lot is to clean it out. And they have that by way of this easement through the park lot. And that's why we would recommend the approval of the vearns.
>> so on 13-a there's no opposition?
>> it's the request -- the developer's request that this be fwranted.
>> okay.
>> the other, the construction agreement itself is standard agreement that basically allows us to draw their fiscals when necessary. The footnote -- plat itself before it's recorded at the county clerk's needs the approval of the Commissioners court and the city council for development. And then the Pflugerville city council meets tonight. I think the staff is just making you aware that before the clerk files it, the city council also needs to approve it before it's filed.
>> that's in your backup to indicate -- (indiscernible).
>> that's correct.
>> so if Pflugerville says no tonight, this matter comes back to us?
>> that's right.
>> I move approval of 13-a and b contingent upon the approval of the Pflugerville city council.
