We have come to executive session. 38, consider and take appropriate action regarding the opportunity to purchase real estate in south central Austin. That's the real property exception to the open meetings act. Let's also put that tha under consultation with attorney 39, receive briefing from the county attorney in del valle isd v. Martin garcia (herminio martinez resale deed), and take appropriate action. Consultation with attorney exception to the open meetings act. 40, receive briefing from the county attorney in del valle isd v. Annie mae wilson (w. Newman casey resale deed), and take appropriate action. Consultation with attorney exception to the open meetings act. 41, receive briefing from the county attorney in del valle isd v. Bailey pink (benjamin cooper resale deed), and take appropriate action. Consultation with attorney exception to the open meetings act. 42, consider and take appropriate action regarding real estate opportunity on the precinct three office buildings property. That's the real property exception to the open meetings act. That's also under the consultation with attorney. 43, receive briefing on wage rate dispute by employees of hutchison construction co. For subcontracting work on the precinct four office building and north rural community center, and take appropriate action. Consultation with attorney exception to the open meetings act. And, number 44, consider opportunity to purchase real estate in central Austin, and take appropriate action. That's the real property and consultation with attorney exceptions to the open meetings act. We will discuss these items in executive session, but we'll return to open court before taking any action.


We have returned from executive session, where we discussed the following item. Number 39 involving the opportunity to purchase real estate in south central Austin. We did ask several due diligence questions. The only question, I guess, is whether we would like for staff to pursue those due diligence issues with an eye toward coming back to court to report in either a week or three weeks.

>> there's a motion, seconded by Commissioner Gomez about the necessary due diligence. If any of the court comes up with additional questions, you can send those to (indiscernible) to get those included. Discussion? All in favor? That passes by unanimous vote. Item, I move that we authorize the county judge to sign a resale deed to herminio martinez who has paid to Travis County the sum of $9,600.

On item 40 and 41, we will repost those items next week and show that they involve the Austin independent school district instead of del valle. 42, we did get a little update there. In my view no action is required. Is there a motion of some sort?

>> 43, we did discuss a wage rate dispute by employees of hutchison construction. We did have discussion. And number 44 we'll have back on the court's agenda on may 11th, '04. In terms of our next meeting, it's the may 18th meeting, right? My question is where are we going to have an abbreviated meeting the Monday before, which would be the 17th or the Friday before?
>> I can be available, but if I have a preference, I would rather do it the Friday rather than the Monday. I need to get on the road on that Monday and drive 6 hours to south Texas for the conference. It would be better if I'm leaving Monday morning early as opposed to Monday morning whatever time we get out of here.
>> then why don't we have it that Friday, which would be the 14th. May 14th we will have a meeting. And instead of just a consent and claims, maybe we could have a little bit more, but we could keep it simple. So instead of having a meeting on may 18th, it will be may 14th. What that means is that we will -- if we meet the 72 hour requirement, we will need to post that and have the agenda deadline Monday or Tuesday before. Tuesday before to get it done.
>> and judge, you and I have can at 12:30, so we should be finish understand plenty of time?
>> yes. Two hours should get it done. On a -- the real controversial stuff we just won't have.
>> so like a 9:00 o'clock like we normally start the meeting. So may 14th?
>> I'm trying to check. I'll check with my office.
>> you good? Okay. What we'll do is have just a meeting that includes all of like the routine stuff and fairly straightforward. We'll come to a very short [ inaudible ].
