39, first executive session item, 39. Consider response from mre ranch, ltd. (medway) on purchase contract approved March 2, 2004 for approximately 344.984 acres of land in connection with the balcones canyonlands conservation plan, and take appropriate action. That's the real property exception to the open meetings act. 40. Receive briefing from county attorney regarding claim against harley davidson, inc., And take appropriate action. That's the consultation with attorney exception to the open meetings act. 40 and 41 is consider opportunity to purchase real estate in central Austin, and take appropriate action. That's the real property exception to the open meetings act. We will meet in executive session to discuss these three items and we will return to open court before taking any action.


We have returned from executive session where we discussed the following items, number 37 regarding the med way ranch.

>> judge, I would move that we would decline the offer of $11 million for the med way ranch property and that we let the owners know that we would give them up to 21 days to respond back to us as to if they feel like there's any other information that they need to get to us. But after that date we will feel obliged to move forward with putting other properties in the pipeline of going forward with --
>> second. Can I have a friendly in rejecting their 11 million that we are simultaneously reurging and reoffering our $8.22 million offer. That one unfortunately had expired a couple of weeks ago much we want them to still consider that one, to say that we reurge that one. But they have 21 days.

>> judge, I would move that we invite harley davidson take them up on their offer to send somebody to town to inspect our vehicles and hopefully they will give us a report that will allow us to do as we see fit.

>> number 41, no action required today, we will have that back on the court's agenda next week in the events that we need to take action. That does it for us today. Move adjourn.
