Item 27

27 ought to be quick. It is to consider and take appropriate action regarding an exchange agreement between Travis County and the city of Austin for land needed for the extension of anderson mill road in precinct 3.
>> this is an agreement we've worked out with the city of Austin for an exchange of property to enable the county to do its anderson mill road cip project. We are taking a little over an acre of land to the city preserve. We are giving them in exchange some vacated right-of-way on Barton Creek road. We are also building for them' game fence along the perimeter of the preserve, a new gate, and we're assuring that there will be no net decrease in the amount of property set aside for the bcp. So we met all the conditions that were set by the city of Austin and their citizens advisory committees. And this agreement I believe now is acceptable from the city's point of view. There was one change that tom was suggesting in the contract. In section c-1, there's a provision that the deed without warranty shall become effective upon the completion of the construction and opening of the appropriate segment of anderson mill road and realignment of lion creek road. We asked that the language also be placed in the deed itself and they are doing that right now and we'll have that also signed by the city. So I believe we have taken care of the issue that tom had mentioned this morning.
>> what we should do, I guess, is authorize execution of that document?
>> that's correct.
>> with the change that you've just described.
>> that's correct.
>> I move approval on that, judge. And I appreciate joe and the staff working hard on this. This is almost something at the end that was going to be a real deal killer for this thing. And joe and the staff really jumped on this deal and took care of it. So I -- and I would like to -- hopefully some of the city council, since they don't get to see me, thank them very often, I appreciate their help with this thing because I think that the mayor's office and everybody worked real hard to get this thing to happen. So this is the kind of thing that I would hope that we could do, you know, in a lot of spots where we have to have this kind of agreement and collaboration. So thanks, joe, for working hard on this deal. I think it's a great deal for us.
>> let me know of that expression of appreciation from Commissioner Daugherty comes from the heart.
>> it certainly doesment.
>> any more discussion? All in favor? That passes by unanimous vote.
