26. A. Consider and take appropriate action on petition for the creation of the Lake Travis community library district. B. Consider and take appropriate action on order calling election for the creation of the Lake Travis community library district. Tamara, we did have the appropate county staff to look at the petition that we received. Didn't we?
>> yes. Please come forward.
>> and we received a certification for a certificate of voter registrar signed by a Travis County voter registrar, nelda wells spears, that says basically a petition must be signed by a [indiscernible] who vote understand the most gubernatorial election, 411 qualified voters meet the statistical requirement and that actually 126 persons -- 1,126 persons, 851 voters were found to appear as qualified voters of the proposed district, so the number was greatly in excess of the 411. It was more than double that. 851. As determined by the voter registrar. And so I move that we define -- find that the petition for the creation of the Lake Travis community library district was in fact in order. And that would be basically for us to approve it. Is that the a that -- the action that a is for, tamara?
>> I don't think she heard your question.
>> basically reapprove the petition.
>> yes.
>> [indiscernible]
>> okay. That is in fact my motion.
>> I second that.
>> before we act to that, any comments?
>> there is one. You have in front of you a -- this relates to the next part of this item, the order in spanish, the map, which is also -- also conforms to the law, the field notes, and exhibits listing [indiscernible] temporary branch, polling places, the polling places are listed in the order itself. One issue still needs to be resolved, is that is -- that is that before the election can be ordered under the law, the petitioners must deposit with the county clerk an amount of money equal to the cost of conducting the election as calculated by the county. And I understand that a check for a certain amount has been deposited. I'm not certain whether that is equal to the cost of the election and I believe that -- that dan is attempting to determine that.
>> okay. Was the amount of the check determined by Travis County?
>> it was -- yes it was. And the amount is $450.
>> last time I think we required $300. We think that the cost has gone up some, so we estimated 450? Is that how --
>> yes. I do believe, though, that dan wanted to verify that with -- with someone in the county clerk's office.
>> dan is probably headed down to the courtroom right now. Any comments?
>> judge Biscoe, Commissioners, my name is nancy [indiscernible] I'm -- i'll introduce rhonda hosteddler, Margaret mcdermott, jean johnson.
>> those are the ones that we saw last week, right.
>> yes, sir, we are.

>> good to see you again.
>> I a couple of things to say, I had a couple of things to say, we wanted to thank you for your attention to our petitions. Thank the judge and each one of your Commissioners, thank your staff for the hard work that they have done. We wanted to thank ms. Tamara armstrong for her attention to detail in our presentation and we wanted to thank the staff at the Travis County voter registration and the Travis County election division for all of the attention to detail and the work that they have done and the help that they have given us to keep us on this path that -- that we are on. If you all have any questions about any part of what we are doing, we would be happy to answer your question.

>> just best of luck.
>> smafbt the media -- as a matter of fact the media asked me yesterday if we had any contentious issues with this thing this time. I said well unless something has cropped up in the last few weeks I said I think that, you know, probably relating to the farmer issue with bee cave, I said no I think that everybody has gotten everything worked out out there, everybody is happy. I would be surprised if this thing is not a 75/80% passage.
>> right. We are looking forward to that.
>> we hope so.
>> to that challenge of campaigning for that election. And have lots of plans in place to let everybody know what this is going to do for them and what a relatively small amount of money for each family that will be involved.
>> thanks for working so hard on it.
>> thank you.
>> we just received word from the county clerk that the amount is actually $400. And we have a deposit of $450. We won't ask you all to contribute $50 to the county [laughter] but I assume that we comply with the law if the amount deposited is in excess of --
>> that's absolutely -- you're fine.
>> we would just refund the $50 I guess after the election; is that okay?
>> that's fine, sir, thank you.
>> thank you. We do have a proposed order that tamara prepared for us. Attached to it and incorporated into it is an exhibit a. That is a map of the district boundaries. Alsoing exhibit b that -- also an exhibit b that are the field notes. This order contains an appropriate terms and conditions that -- that ensure compliance with the law, right, tamara?
>> correct.
>> okay. So our next action, I guess part of b is to call the election for this -- is this another may 15th election?
>> yes, it is.
>> may 15th of 2004 and the voting places are contained in section 7.
>> yes.
>> of the proposed order.
>> election day -- polling places.
>> election day polling places.
>> and the early voting polling places are listed in exhibit c.
>> judge, we didn't vote on a yet declaring the petition to be valid.
>> let's go back to a, all in favor? That passes by unanimous vote. Now, b would be everything that we just discussed and that deposit seems to be a little more important than necessary. But we got is resolved. B he is to consider and take appropriate action calling election for the creeftion the Lake Travis -- creation of the Lake Travis community library district. Including attachments, a, b, c the deposit is in order. Tamara, I believe that covers everything. Commissioner Daugherty moves approval.
