Executive session. Number 30 is receive briefing and take appropriate action in claim reian taylor versus margo tpraeugser. 31. Receive briefing from county attorney and give direction and take appropriate action and/or accept, reject, or counter a settlement offer from antonio vargas hernandez in the matter of Travis County, Texas v. Antonio vargas hernandez, francisco campos and isabel huitron, a00372500990201. We postponed item number 32 for two weeks. It will be back on February 10th. Number 33 -- beg pardon? 31, yes, consultation with attorney only. 33. Receive briefing and take appropriate action in frederick pluet, (deceased) v. Margo frasier, et al. That's consultation with attorney exception also. We indicated we would postpone item number 34 until next week. 35, 36, 37, 38 until next week. Those are the matters srofpling chautauqua foundation. 39. Receive legal advice from county attorney regarding various questions under the Texas open meetings act. Consultation with attorney exception to to the open meetings act. 40. Receive briefing from county attorney and/or give direction and/or take appropriate action and/or accept, reject or counter settlement demand and/or authorize county attorney to initiate condemnation regarding project #01b01-09-2ca, grand avenue parkway; parcel no. 17; elena perales, and Travis County, Texas (elena perales; gieselman; condemnation). (requested by the county attorney). Consultation with attorney exception to the open meetings act. 41. Receive briefing from county attorney and give direction and/or take appropriate action in rosenbaum v. Travis County. Consultation with attorney exception to the open meetings act. And the last item we'll discuss in executive session will be number 42, receive briefing from county attorney and/or give direction and/or take appropriate action and/or receive summary of special Commissioners hearing and/or accept, reject or counter settlement demand regarding project #01b01-09-2ca, grand avenue parkway; parcel no. 3; thomas d. Shaffer and debra v. Shaffer, and Travis County, Texas (thomas d. Shaffer and debra v. Shaffer; gieselman; condemnation). Consultation with attorney exception to the open ofpl. We will discuss these matters in executive session but will return to open court before taking any action.



number 30, involves the claim of taylor versus frasier.
>> I move we accept $78,750,000 counter offer and in demps to Commissioner Gomez for today for the purposes of getting this thing settled that the source of funding be out of risk management but that this item be brought back in case the court may have a different observation about what should be the funding source. Or not.
>> any more discussion? All in favor? That passes by unanimous vote. Number 31 involved the -- the claim of -- of Travis County against antonio vargas hernandez. Move that we accept the counter offer in the amount of $10,000 to get this matter over.

On number 39 we did get various questions answered by the county attorney and had a chance to ask additional legal questions regarding Texas open meetings act. We all feel much more informed, even if we do not show it during the next few months [laughter] 40 involves the grand avenue parkway project we previously settled this matter and they are still working on the settlement documentation.

>> 41 is the action by mr. Rsoenbuam by Travis County.
>> judge, I would move that contingent on the Travis County attorney's office drawing up an agreement where mr. Rosenbaum would sign-off on any further liability of Travis County, that the motion would be that p.b.o. -- instruct p.b.o. To transfer $70,000 from the reserve fund of number 456 to supplement the existing budget, which is roughly 108,000 to pursue settlement with the rosenbaum claim.

On 42 we we did get good news from the Travis County Commissioners court indicating that a special Commissioners group has made theory ward of -- made the award of $35,000 from Travis County to the schaefer family. They have made a counter.
>> judge, I move that we reject their counter offer in the amount of 45,000 plus a driveway scenario. And the would be no counter.
