On item no. 8, we did -- which we did include in the consent motion, this just caught my attention a few minutes ago. We approved -- this says basically that we have not received the requisite fiscal yet. Rather than postpone the item, your staff requests that the court approve the agreement with the proviso that no permit can be issued. Until we have received the fiscal security that goes with the agreement. My first question is did we receive that yet?
>> no, we have not.
>> my second question is do we need to bring that back up and impose this condition?
>> yes.
>> move that we reconsider item no. 8.

>> all in favor? That passes by unanimous vote. The recommendation from staff is that we approve this agreement but conditioned upon the county receiving the fiscal security that the agreement references and further that without that condition being met that the agreement, though, approved is not -- is not effective. They may tell us a better way to word that legally, but I think there's a gist of what staff recommend, I recommend approval of that.

>> all in favor? That passes by unanimous vote. Joe, I think somebody has to -- to either come over in the morning, on Tuesday morning or like call me or somebody. I mean, I don't read e-mails first thing Monday morning. I stayed until 5:45 yesterday and worked last night, but I wouldn't know this myself.
