That brings us to executive session. We were asked earlier today to pull item number 47 and have it be put back on when it's ready for us. And we do have a full executive session agenda today. Item 41 is to receive briefing and/or take appropriate action in michael s. Hanson versus hollywood video, incorporated, et al. That's the consultation with attorney item to the open meetings act. 42 is to receive briefing from county attorney and give direction and consider representation of Travis County regarding Travis County medical examiner's facility and take appropriate action. 43, receive briefing from county attorney and authorize county attorney to accept, reject counteroffer or settlement our and/or take appropriate action in cause number gn-300127, Austin 1825 fort view, incorporated versus Travis County Texas in the 353rd district court of Travis County. That's the consultation with attorney exception to the open meetings act. 44 is to receive briefing and take appropriate action regarding ongoing litigation and congressional redistricting matter. I move that we authorize alicia perez to send to her counterpart at the city of Austin an appropriate letter simply calling to the city's attention the exist tense of our new precinct 4 building and that the fact that there will be ten thousand probationers with many criminal offenses coming there on a day-to-day basis.

>> any more discussion? All in favor? That passes by unanimous vote. On number 46, I move that we authorize the extension of leave with pay from five days as authorized by our policy to six days, so that's an additional day. This is basically ratifying action already taken.

On 48, because we have received the sum of $4,361.41 I move that we authorize the execution of a resale deed to jonathan Moore and that we authorize the county judge to sign on behalf of the Commissioners court.

On number 49, I move that we authorize to -- to the county judge to sign the prepared resale deed to bobbie green, he has paid us $1,200 for this -- $2,500 for this matter. This involves a little issue involving the title and structures already on the premises that we would like to take note of officially. Any more discussion? All in favor? That passes by unanimous vote. On number 50, move that we execute a resale deed to tony cernosek, who has paid to Travis County $7,500 in cash.

>> all in favor? Move approval. Mr. Cernosek again in 53, move that the county judge be authorized to sign on behalf of the Commissioners court a resale deed to him because he has paid to us the sum of $3,400 for the tract of land in question.

>> all in favor? That passes by unanimous vote. We did agree to postpone consideration of 54, 55, 56 and 57. All of those tracts of land chautauqua foundation has made an offer to us, in our view the offer is reasonable based on the total circumstances. However, we do think that it's important for us to see a written description of the plan, planned use, for this land that the foundation has and so we will put this back on the agenda for next Tuesday. And if owe owl if it's ready then -- and if it's ready then we will act on it. If not we may have to take another week. We did discuss this this with Commissioner Davis and he is in agreement.

And number 58, this matter we have an offer to purchase, after we got no offers at the public school. But jules caplan basically deposited with us a cashier's check in the sum of $50,000 and I move that we authorize the county judge to sign on behalf of the Commissioners court to give mr. Caplan a resale deed for this amount of money.

>> any more discussion? All in favor? That passes by unanimous vote. We did get a briefing from the county attorney in 59. It was informative and educational, no action required today. We discussed 60 in part, we will need to finish that discussion next week. So number 60 will be back on the court's agenda next week. Now, on the item that we discussed previously, number 37, we did not discuss this in executive session. But we said that we would revisit it. If in fact the referendum language is handled at the state level, and we don't need to do anything locally, then it won't hurt us to take one more week on the resolution. Everybody does have the backup now, so let's consider the resolution and whether we will follow their request, number 3, on page 1, to contact local media and community leaders and basically provide public awareness on the issue of unfunded mandates as requested by the Texas association of counties. We will just have this 37 back on.
