3. Discuss request to approve the vacation of a 15' access easement in northtown park section three and section five, two subdivisions in precinct 1. -- in precinct 3.

>> good morning. Joe gieselman with the transportation and natural resources department. This is an access easement that was originally dedicated by separate instrument in 1986. Subsequent to that, in 1993, portions of the subdivision were vacated. Unfortunately, this access easement was not vacated at that time. So now in the replatting of the subdivision, this access easement still exists, legally. The owner of the subdivision has asked that this access easement be vacated and that is the subject of today's action. All of the property owners and the utilities have been notified. There may be one property owner adjacent to the access easement who objects, at least that seemed to be the indication. I don't know of any other objection. And the purpose of this is to have a public hearing where anyone who is either in favor or not in favor of the vacation can come forward and address the court.

>> yes, that's correct.
>> we went out of our way to notify that property owner of this public hearing today?
>> yes, we did. As well as we have the general notice at the site.
>> okay. Would anyone like to give testimony during this public hearing? If so, please come forward.
