Now let's call to order the Travis County housing finance corporation. We had posted this item number one, elect officers of corporation. Do you want to do that today?
>> I'm ready.
>> one is to elect officers of the Travis County housing finance corporation.
>> judge, I would move the current legislate of officers to stand as it is.
>> any discussion? You know i've gotten used to being president.
>> and you do such a great job. [ laughter ]
>> thank you for the compliments today. You're full of them today, aren't you? Let me get a vote before you change your mind. All in favor? That passes by unanimous vote. Number two is to approve membership invoice from Texas association of local housing finance agencies and take appropriate action.
>> good afternoon, harvey Davis, manager of the corporation. I'm asking the board's approval to continue our membership in Texas association of local housing finance agencies, and the membership is $175.
>> move approval.
>> second.
>> and we get more than 175 dollars' worth of value.
>> yes, we do.
>> second.
>> any more discussion? All in favor? That passes unanimously. Number 3 is to receive briefing from corporation attorney. That's david blount. Give direction and/or take appropriate action regarding collection of paste due annual fees.
>> isn't that in executive session?
>> that's an executive session discussion, isn't it?
>> we have one in the other corporation. Can we double them up?
>> yeah. Tell you what, we will announce that we will take this item into executive session under the consultation with attorney exception to the open meetings act. And having done so, let's call to order the Travis County health facilities development corporation. First item, elect ferz of the corporation.
>> move the Biscoe shrait.
>> second.
>> all in favor? That passes unanimously. And number two is the same as number two under the housing finance corporation. We'll need to take both items into executive session. And so two is to receive briefing and advice from council regarding settlement office -- offer?
>> probably offer from commonwealth land title company and take appropriate action. This is consultation attorney exception to the open meetings act also, which we will take in executive session along with the other item under the health facilities corporation, and welcome back to open court before we take any action. Act.
>>
>>
>> we have just returned from the executive session under the Travis County housing finance corporation where we discussed item no. 3 involving collection of past due annual fees from lake view apartments. Move that we authorize legal counsel to send an appropriate letter to the owners of the apartment complex, a copy to the trustee in which we ask for a written proposal on how to satisfy fees in the amount of $56,000 currently owed and past due. And that we request that we get delivery in time for us to consider the proposal at our meeting next Tuesday. And so my recommendation would be -- the motion would be to postpone this action until the 20th. And what we're looking for is some way to protect the interest of the public. This is one of those projects where real property taxes were waived as part of the deal. That was the substantial financial benefit to the apartment complex. In exchange, what the people get is a small annual fee. And right now two annual fees are due and owed.
>> second.
>> any more discussion?
>> judge, would there be any part of that -- isn't this all three of the properties? Do we have to address anything about the other two and we're just waiting? We're anticipating that those checks are going to come, but in the event they're not here by, say, next week, do we wait to see?
>> I was going to take action if they're not here. On those I think we need to get more than a promise. Hopefully we'll have it in hand. So I think the wording is broad enough for us on get something on those. On the other two we basically are relying on their promise to put a check in the mail. Did they say when, mr. Davis?
>> well, yes. Both of them indicated it would be within the next week. And then -- there's no -- only the current year's fee is due. They have paid the fees in prior years, and so I do not --
>> it seems to me good for us for mr. Davis to give them a little friendly reminder and a request that we receive that money before next Tuesday's discussion.
>> I will do that.
>> i'll do that.
>> and if there's no objection to it --
>> it's friendly to the second.
>> any more discussion? All in favor? That passes by unanimous vote.
>> move to adjourn.
>> all in favor? That passes by unanimous vote also. We also discussed item number 2 under the Travis County health facilities development corporation. We got a counter to our counteroffer to settle in this matter.
>> judge, I move that we reject their counter of $35,000 and counter their counter in the amount of 40.
>> any more discussion? All in favor? That passes by unanimous vote.
>> was that 40?
>> 40.
>> move to adjourn.
>> all in favor? That passes unanimously also.
