Item 41

We have been advised that one of the executive session items, specifically number 41, need to be discussed in open court. Then we'll take that terror insurance item up next. 41 is to discuss, approve and take appropriate action regarding the extension of the lease for 2919 manchaca road.
>> morning.
>> this is regarding the jp 3 and by the constable of precinct 3 that's in manchaca. The lease there, we're currently in a one-year automatic extension time period. Under this agreement we have the right for another one-year automatic extension. The lease does not require us to give notice, but we want to exeer exercise that. It just requires us to give notice if we don't want to exercise the one-year extension. The deadline to let them know if we don't want to do that is December 31st. So that's why this is on the court today.
>> so doing nothing it just automatically extend?
>> that's correct.
>> as far as I know we're not ready yet to move into new places, so it would be lovely to have offices to continue on to. And does this lease say that we can bail with -- move to county-owned space?
>> yes, there is an early termination provision that allows us to move out if the county purchases a building for that purpose.
>> okay.
>> but the recommendation today is what?
>> just we're here to advise the court today, we do have a memo -- we have a letter prepared ready to send them to give them the notice that we will be exercising as a matter of courtesy. It's certainly not required under the lease. There are some other issues which we will be bringing to the court next week under consultation with your attorneys. So we will be discussing this next week as well.
>> but the advice today is to approve sending the letter from facilities?
>> yes. Or just do nothing.
>> that's the legal advice today?
>> that's correct.
>> move approval.
>> second.
>> that is that the notice be sent to the landlord. Next week we'll discuss the other issues in a separate posting.
>> right.
>> any more discussion? All in favor? That passes by unanimous vote. Thank you very much. The other executive session items we will discuss in executive session this afternoon.
