Now let's call to order the Travis County health facilities development corporation. The first item is an executive session discussion, receive briefing and legal advice or advice from counsel related to vision village and there will be under the consultation with attorney exception to the open meetings act. And so now we will convene in executive session to have the discussion and we will return to open court before taking any action.
>>
>> we have just returned from executive session where we discussed item no. 1 under the Travis County health facilities development corporation.
>> judge, I would move that we institute a -- a counter to the title company that we are willing to settle our differences with them in the amount of $50,000.
>> second.
>> any more discussion? All in favor of the motion? That passes unanimously. Number two consider and take appropriate action regarding request to approve restitution agreement with a&r vision, inc. Related to vision vill take.
>> this is a -- this is an opportunity to recover some money out of the millennium village project. Several of the individual, I know of at least two, it may be one or two other ones will be making restitution payments related to that project and this is an agreement where we are agreeing with the city to split those restitution payments, basically pro rata, based on the amount of money that corporation loan plus the city loan plus the other factor is the utility costs that have not been paid and I believe our -- it's approximately 1/he will of all of the rest -- 1/8th of all of the restitution payments would come to the corporation.
>> cliff, you may not have this answer but if you could find on it you the for us. It appears on the first page of the restitution document at the bottom under onations that the case went through judge wisser's court in October of 2002 and that the person was supposed to make payments beginning on October 26th of last year in the amount of 2,000 a month. If you could just find out for us, please, if indeed there's already 12 months worth of moneys out there and if we will get a split of those 12 months worth of moneys or if there was a delay made in terms of when day one would be.
>> I think that I can find that out and let you know.
>> that would be great, thank you.
>> judge, I would move approval of the signing of the assignment of restitution document.
>> second.
>> based on all of the facts this is probably as fair as anything else under the circumstances.
>> under the circumstances.
>> any more discussion? All in favor? That passes by unanimous vote.
>> move adjourn.
>> second.
>> all in favor? That passes by unanimous vote, also.
