We are ready for executive session. I did check with jim collins over lunch and he advised me item number 52 will take a work to get done. Let's postpone 52 until next week, October 7. 46. Receive briefing from county attorney and authorize county attorney to accept, reject or counter offer for settlement and take appropriate action in the matter of david m. Grassbaugh v. Travis County, Texas, dinah dinwiddie, elaine carpenter and terry esquivel, cause no. 99-06730, in the 98th district court of Travis County, Texas. That will be the consultation with attorney exception to the open meetings act. 47. Receive briefing from county attorney, give direction and take appropriate action and authorize county attorney to initiate condemnation regarding project #01b01-09-2ca, grand avenue parkway; parcel no. 3; thomas d. Shaffer and debra v. Shaffer, and Travis County, Texas. Consultation with attorney exception to the open meetings act. 48. Discuss and take appropriate action regarding the lease between harry whittington, dba travis properties and Travis County for office space located at 209 west 9th. That will be the real property exception to the open meetings act. We may as well throw in the consultation with attorney in 48 just in case. 49. Consider and take appropriate action on aus-tex concessions contract at exposition center. Just a couple of legal questions there. Advice of counsel exception to the open meetings act. 50. Discuss and take appropriate action regarding the lease for the north rural community center and clinic. Real property exception to the open meetings act. 51. Discuss and take appropriate action regarding the lease between Texas rural legal aid, inc. And Travis County for office space located at 2201 post road. Real property exception to the open meetings act act also. 52 we postponed until next week. 53. Consider and take appropriate action on acquisition of 12.21 acres of property from rev. Aaron taylor, et ux., For assemblage with east metro park in precinct one. Real estate exception to the open meetings act 54. Consider and take appropriate action on lease at 2919 manchaca road, precinct three justice of the peace and constable offices. Consultation with attorney and the real property exceptions to the open meetings act. We'll discuss these matters in executive session, but will return to open court before taking any action.@

Item number 28 eye move approval of the new lease that's been prepared by our real estate manager that is very clear in terms of the amount of space that we are renting for the i.d.f. Closets and the appropriate amount which is $5,428.80 for another 12 months. That's for the full year. Is that correct?

>> 10-14. Number 50 involving the lease in Pflugerville for the north rural community center and clinic, we need a one-month extension. And the landlord is requesting payment of a certain amount. My motion is to request a one-month extension.

>> do we want Biscoe negotiation? I think we ought to communicate to the landlord we think a 50% penalty would be appropriate in view of our long-standing and positive relationship and our potential for doing business in the future. And along with that express our deep appreciation for his willingness to work with us on that -- on this. We know that it's imposing some inconvenience and we believe that 50% penalty would compensate him for that. We hope he agrees.

Number 51 involves the lease of space at 2201 post road by the Texas rural legal aid, incorporated. Move that we authorize and execute a 90-day extension under the same terms and conditions and indicate to the tenant that we will consider its request before the end of this calendar year right along with other requests for use of the same property.

>> any more discussion? That's the purpose for the 90 days, and 90 days we'll do something more long term. All in favor? That passes by unanimous vote. Number 52 involves the -- we postponed that, didn't we?

>> earlier, so we did not discuss that item anyway. On item 53 involving the taylor property for east metro park.
>> yeah, and judge, I move that we direct Travis County t.n.r. Staff to draft all the necessary contracts and papers for the reverend aaron teller and his wife. They did accept a counteroffer of $240,000 for the 12.21 acres with the assemblage with east metro park, and also indicate within this motion that the t.n.r. Department will absolve the approximately $2,500 of closing costs and title insurance for this particular transaction. And move forward.

>> I would like to thank the reverend teller and his wife very much for their consideration, their time and effort that we put into this. We're appreciative of that.
>> I guess we need to put in the agreement our willingness to allow them six months -- occupancy.
>> six months for relocation. Definitely, that was part of the agreement. And also some language in the contract that will indicate their willingness to have some language that they generate telling a little brief history about their family, a little plaque and things like that so they would have that displayed on that particular property so that all of it will be within the contract itself.

Number 54 involving the 2919 manchaca road real property, we have a note from the county attorney. The Commissioners court, I move that we direct the county attorney's office to take necessary steps to abate the rental costs for space that was not utilized by Travis County but was covered by previous rental payments. That's the motion.
>> specific reference to the co 2 issues and this is not a regurgitation of our mold eurs which have already gone in terms of abatement. -- mold issues.
>> that's my understanding. That's their language verbatim. That's the co 2 issue, right?
