We have come to the executive session part of our meeting. Now, yesterday we did recess the constable and jp budget session, so let's announce that one under the consultation of attorney exception to the open meetings act. 45 is to receive briefing from county attorney and take appropriate action regarding fluor daniel incorporated versus Travis County, Texas. Number 02-50378, in the united states court of appeals for the fifth circuit. Consultation with attorney exception to the open meetings act. 46, consider and take appropriate action on a purchase contract with charles ribelin and martha ribelin, thomas francis, lucia francis and ribelin ranch partnership limited for the acquisition of approximately 319.7809 acres of land in connection with the balcones canyonlands conservation plan. That will be the real estate exception to the open meetings act and also the consultation with attorney. 47 is approve or reject proposed farmer's market lease agreement with jennifer kunze, d/b/a general jenny's bake house and deli. Real estate exception to the open meeting act. 48, receive briefing from county attorney and take appropriate action regarding barbara oakley as legal guardian for richard danziger versus city of Austin, hector polanco, et al, consultation with attorney exception to the open meetings act. And 49 is to consider and take appropriate on claim by james a. Smiley for compensation for work performed while an employee of franklin woodberry, d/b/a sterling jan toarl services on a Travis County construction project. We'll discuss those matters in executive session and return to open court before taking any action. The last one? Sure.

>> judge, I would move that we extend the offer that we have got for our appraisal and that we also give them a 90-day extension, maybe get back with us to either accept or deny our offer.

We had a discussion with the county attorney's office. We'll have a follow-up discussion and be posted for appropriate action next Tuesday. Any action necessary today? All right. Number 49 involves the claim of james a. Smiley. I move that we agree to pay one half of mr. Smiley's claim. That would be in the amount of $751.38. And that we identify the source of funding, the cjc reserve. If there's no money there, the risk management reserve. And that we authorize and direct that we expedite payment as much as possible. And that we obtain from mr. Smiley an appropriate settlement and release similar to the one that we obtained in the last case.
