Executive Session
The following executive session items are posted for executive session discussion. 29, receive briefing from county attorney and take appropriate action in marcie caldwell versus carole rylander, comptroller of the state of Texas. Consultation with attorney exception to the open meetings act. 30, consider request to the Texas turn piem authority to design and construct an interchange at the proposed howard lane arterial during initial construction of state 130 and take appropriate action. Consultation with attorney and rematters exceptions to the open meetings act. 31, receive briefing -- receive legal advice and take appropriate action on county compliance with sb 5, reducing air pollution, energy efficiency and conservation. On that really we need a better idea of the legal requirements. When back in open court probably we'll need to discuss compliance steps already taken and what additional steps need to be taken over the next few months. D, receive briefing from county attorney and authorize county attorney to accept, reject, or counteroffer for settlement and take appropriate action in the matter of merlin handily versus Travis County, city of Austin, Texas, dinah, dinwiddie, individually and in her official capacity, casey ping, cause number 102 ca 606 jn in the united states district court, western district of Texas, Austin, Texas division. That will be under the consultation with attorney exception to the open meetings act as well as 31 if I didn't announce that. We will discuss these items in executive session and return to open court before taking any action.

I move that we authorize the county attorney to accept a settlement of this matter by waiving our entitlement to any attorney's fees in exchange to our getting out of this lawsuit, as to keep and every claim now and forever.

We did get an update. Hopefully next week we will be adyo take a tion on it. On number 32, we did discuss that matter. In view of the fact that there are hearings before the judge this Thursday, let's have that back on the court's agenda next Tuesday. For any appropriate follow-up .
