We have come to the executive session items. 27, receive briefing from county attorney and take appropriate action regarding flurry daniel versus Travis County Texas. Number 02-50378 in the united states court of appeals for if fifth circuit. 28, receive briefing from the county attorney in Travis County versus walnut cream improvement association. Tri ta and tom dinh resale deed and take appropriate action. Consultation with attorney exception to the open meetings act. I don't know if I said that on 27, but 27 and 28 are consultation with attorney matters. 39, receive briefing from the county attorney in Travis County versus heritage bank, tony cernosek retail deed, and take appropriate action. Consultation with attorney exception to the open meetings act. 30, receive briefing from the county attorney in Travis County versus sung k. Park and young o. Park, tony cernosek resale deed, take appropriate action. Consultation with urn p attorney exception to the open meetings act. Receive briefing from the county attorney in Travis County versus e. L. Buice, tracy a. Suire resale deed, and take propose action. Consultation with attorney exception to open meetings act. 32, receive briefing from the county attorney on the anderson mill road project. That's the consultation with attorney exception and the real estate accepts exception to the open meetings act. And the final item for executive session today will be 36, receive briefing from county attorney and take appropriate action regarding barbara oakly, as legal guardian for richard danzinger versus city of city of Austin, hector polanco, et al. Consultation with attorney exception to the open meetings act. We'll discuss these in executive session and return to open court before taking any action.
>> we have returned from executive session where we discussed the following items. Number 27, we did get an update. No action required today. Right? Number 28, I move that we authorize the county judge to sign the tax resale deed to tri ta and tom dinh for the amount of $52,567.66, which we have received.

>> all in favor? That passes by unanimous vote. On number 29, I move that we authorize the county judge to sign the tax resale deed to tony cernosek. This covers two lots and the amount of cash received is $4,500 on each for a total of $9,000. So two lots totaling 9,000, $4,500 each.

>> all in favor? That passes by unanimous vote also. And on item number 30, move that we authorize the county judge to sign on behalf of Travis County a resale deed to tony cernosek for the amount of $3,500, cash that we've already received.

>> all in favor? That passes by unanimous vote. And on number 31, I move that we authorize the county judge to sign a tax resale deed to tracy a. Asurie for the amount of $4,948.60, which we have received.

>> favor? That passes by unanimous vote. On number 32, we did get a briefing on anderson mill road, but no action is required today. That will be put back on when necessary. 33 was pulled. That will be put back on when we need it again also. And on item number 34 involving the claim of Travis County against the jc evans construction company, I move that we authorize the county attorney to convey a counter to the counteroffer in the amount of $180,000, payable in five equal quarterly payments, the first of which is due on June 1st of 2003, and to give 30 days to pay before the payment becomes late, but with the understanding that if there is a late payment of more than 30 days that the whole amount becomes due and will be sued on and that whole amount is $725,000.

>> any more discussion? In my view, this is like a hybrid of the two possibilities that we have discussed.

>> right. All in favor? Show Commissioners Davis, Gomez, Daugherty, yours truly vote willing in favor. Voting against, Commissioner Sonleitner. Item number 35, I move that thecourt authorize the county judge and Commissioner Daugherty to take the last offer from the seller in this case and to work with the seller to try to get an additional 100,000-dollar contribution on the roof that needs to be replaced, and that the two of us remain mindful of the 5:00 o'clock Thursday deadline and that the maximum amount that we can spend be the amount of the counter.
>> I’m not sure I understood the last thing you just said, judge. You had me until the last.
>> the amount that they sent back to us. The maximum amount would be what we do today. We need the contribution to the roof to reduce that maximum. If we cannot reduce that maximum by 5:00 o'clock Thursday, we would basically accept it.

>> you understand that? I think it's consistent with what we talked about.
>> yeah, going to the parameters we've been --
>> there are too many ways that we can work it out.
