That brings us to executive session. We do have a last minute request to postpone two items, actually to pull number 40 until further, and to pull 43 until efficient notice. We previously indicated a -- a similar request had been made for 41.

Discuss applicants for the position of executive manager for justice and public safety, and take appropriate action, that's the personnel matters exception to the open meetings act. 39 b consider recommendations for covering these functional areas without an executive manager, and take appropriate action. Personnel matters exception, also. Them we jump to 42. 42. Receive briefing from county attorney, discuss proposed settlement and give direction regarding collection claim of Travis County vs. J.c. Evans construction co., Inc. And take apropriate action. That's the consultation with attorney exception to the open meetings act. 44. Receive briefing from county attorney and authorize county attorney to accept , reject, or counter offer for settlement and take appropriate action in the matter of robert p. Maddox jr. V. Travis County, Texas, cause no. Gn-002616, in the 261st judicial district court Travis County, Texas. Consultation with attorney exception to the open meetings act. 45. Receive briefing and take appropriate action regarding plaintiff's request for mediation in fredrick pluett, (deceased) v. Margo frasier, et. Al, (pluett; frasier; civil rights.) That's the consultation with attorney exception to the open meetings act. Our final item will be item no. 46. Consider accepting, rejecting, or countering a counteroffer to sell right-of-way for the grand avenue parkway 2001 bond project, parcel number 18. That will be the consultation with attorney and the real estate matter exception to the open meetings act. We will discuss these items in executive session and we will return to court before taking any action.
>> we've just returned from executive session. Where we discussed the following items: 39 a and b, no action required today. We'll have that back on the court's agenda next week, April 8th. Number 42, move that we accept the counteroffer to accept five payments, but to insist on the language that we had recommended regarding default caition. Any more discussion? All in favor? Number 44, move that we authorize settlement on the terms the parties have agreed to, including us, and authorize the county judge to sign the document appropriate documents once the settlement papers, including appropriate supporting documents have been presented.

>> judge, I would move that we reject the last offer from the owners of parcel number 18 and we counter in the amount of $30,384.
