24 is to approve modification number 3 to contract 99 ae 601-jj, martinez, wright and mendez, professional engineering services for the ferguson lane - tuscany way design project. I believe commissioner Davis has a question on this, right? -- commissioner daugherty has a question on this. And it is?
>> is this basically a result of something that was sprung on us, if you will, by the city of Austin?
>> yes. And -- I guess we probably need maybe carol can address this since this is out of t.n.r. 24. I was ready to speak on 24, but I'm sorry.
>> basically what we have on the project is the city and capital metro are contributing funds and once we started the city ines -- they had a tree replacement line and a water relocation plan that had to be redesigned. And for that we will be paying mendoza about $17,000. Of course, the city and capital metro are contributing funds to the project, so the budget is there and --
>> was there not the anticipation of that before the project?
>> no --
>> I mean, would the annexation?
>> no, I don't believe that it was anticipated.
>> did we know they were going to annex that portion of the road?
>> that's been one of those projects that's been going on for years.
>> we've been -- at one point we started with them trying to annex and then deannex because the problem for ferguson is in the tuscany way area. The real problem is in the tuscany area.
>> is the difference of the #- 9,000, is that -- 99,000, is that all be picked up by city of Austin and cap metro?
>> there is no real differentiation between who is paying -- which portion is theirs versus ours. They are all contributing, capital metro has about $750,000 and the city of Austin 781,000, so it would be six to one, half dozen to the other.
>> and the counties are half a million.
>> is it fair to say we have capped -- I don't want to say the word "capped." We are contributing 500,000. If you all all those three dollars together it's about $2 million and even with this new wrinkle we're still within the contingency amount. So this takes away from the contingency but does not add to anything further the jurisdictions would have to --
>> it looks like the projected costs with this increase is 1.8. So you are still in your budget.
>> and again, carol, this has been a problem that's been in existence for a long time.
>> oh, yeah.
>> it's been around for a while. And having to work with three different ent advertise and then the -- entities and the things that took place has posed some problems, but of course from there we're at the stage of [inaudible] because of a few things there, but [inaudible].
>> and therefore that change brought the modification.
>> move approval.
>> second.
