>> I move that the public hearing be opened.
>> second.
>> all in favor? That passes by unanimous vote.
>> good morning, carol joseph, t.n.r. The owner of -- of one lot wishes to resubdivide a 3.49-acre lot into 3 lots, two one acre each and one -- 1.49 acres, we've had no issues, we have received no complaints, no issues on this item and t.n.r. Recommends approval.
>> any objections called to our -- we just covered that. Would anyone like to give testimony during this public hearing? If so, please come forward.
>> see none.
>> [multiple voices]
>> please come forward.
>> give your name, we would be happy to get your comments.
>> my name is rob [inaudible] I'm a home owner in the area. We have had water drainage issues on bee cave ranch road for quite a few years. We have got no problems with -- we've got no problems with the subdivision from one tract to three tracts. The problem that we are going to have is the water drainage off the driveways and roof tops. I live in the neighborhood, I own property in the neighborhood. We have been trying to build a house for 20 month, we've had our utilities washed out of our driveway three times this year. It's cost my family almost $20,000 putting it back in the ground. I've had a lot of conversations with stacy sheffield, fred denick, larry shewi --
>> steve.
>> we've met the surveyors and engineers up there, they have all said the same thing, this is a huge problem, we don't know how to deal with it. What I asked them to do so that I could get my approaches down, try to stop this water coming down our driveway, off the bluff and heading downstream -- hitting down strem residents, we have water coming into the houses, not just our driveways, but coming into the houses of the neighbors behind me. They issued -- fred dennick got a work order reissued to reshape the bar ditches across the street from us, which hopefully will help. But there's a real problem up on bee cave ranch road --
>> are you in favor of this or against it?
>> I want to know what the county is going to do with the water. Can you chat with him a few minutes why don't you join them in the executive session room right across the hall. The issues that you mentioned were not set forth in the backup, but they may be able to address your concerns. That may be a better use of our time this morning. If you call me over lunch, I guarantee I will let you know when we will reach it within 30 minutes.
>> are we going to leave the public hearing open, judge?
>> yes, why don't we move to do that.
>> keep it open.
>> I move to keep it open.
>> second.
>> all in favor? That passes by unanimous vote. We will call that back up before they announce they are ready.

/ >>We are going to postpone the action -- the public hearing is fine to approve, but we will postpone the action on item 9 at least to one week.
>> okay.
>> item 9 will be back on the court's agenda next week.
>> do we need to move to close.
>> yes. I move that we open the public hearing on number 1.
>> second.
>> all in favor? That passes by unanimous vote. Anybody else to give comments on item no. 1, the public hearing that we started and then recessed?
>> move to close.
>> second.
>> all in favor? That passes by unanimous vote. Thank you very much, we will have number 9, the action item, back on the court's agenda next week.
