Number 2 is a public hearing to discuss order authorizing the filing of an instrument to vacate a drainage easement on lots 24 and 25 westview estates section 2, in precinct 3.
>> I move that the public hearing be opened.
>> second.
>> all in favor? That passes by unanimous vote.
>> carol joseph, t.n.r. This initially was platted as a drainage easement when they -- when -- dedicated as a drainage easement plat within westview estates. Review by the engineers have decided that the easement is not through there and what they are asking is that we vacate the easement and they are allowed to fill it in later on.
>> any objections called to our attention?
>> no, sir.
>> would anyone like to give testimony during this public hearing? Oops, yeah, please come forward. If you would give us your name, we would be happy to get your comments.
>> my name is --
>> have a seat there.
>> state your name.
>> my name is allan rains with action blair engineering. We are the firm who did the drainage for the new easement, basically what we found when we did the study was that the current easement is inadequate and relative to its location to the ditch and in its size, what we are proposing to do is vacate the existing easement and dedicate a much wider easement. The impetus for us actually being involved in the property was the owner was placing fill on the property. It appears to us for some time. The previous owner, also. They were red tagged by the county and asked to fix the situation. What we found was that the placement of the fill actually literally over time moved the -- the ditch so the original easement was no longer centered on the ditch. The original easement appeared to be dedicated for an undeveloped watershed condition. So it was grossly undersize for the flow we would expect in a fully developed watershed condition, which would be a current standard. So we are proposing to vacate the existing 30 or 40-foot wide easement and dedicate the easement that's about 80 to 200 feet wide depending on the location that actually catches the drainage. That was all that I had and then a formal presentation, but if you all have any questions --
>> any reason why we should not do it?
>> I'm sorry?
>> any reason we should not do it?
>> not to my knowledge, no, sir.
>> anybody else to give testimony during the public hearing, this will be action item no. 8. I can almost assure you that we will grant your wish today.
>> second.
>> move that the public hearing be closed.
>> all in favor that passes by unanimous vote.
