Now, item no. 9 is the matter involving the application to appropriate the community of volente. To take that up in executive session. Under the advice of council under the open meetings act. 52. Discuss, approve or take any appropriate action regarding countylerk lease space. That's the real property exception to the open meetings act. 53. Discuss, approve or take any appropriate action for the remodel of the 1st floor entry lobby of the granger administration building to improve security. That's the real property exception to the open meetings act. That's the security exception to the open meetings act. 54. Consider request from Travis County judges regarding workplace safety issues at 1622 e. Riverside drive, Austin, Texas, and take appropriate action. >> [inaudible] item 40 is to approve contract award for refuse collection to the low bidder waste management of Texas. That will be the consultation with attorney exception to the open meetings act also that we have discussed. We will come back on open court, though, before we take any action. There is some backup on some of these items that we may need.

>> item 58, personnel issues regarding starflight staff, receive legal advice and take appropriate action. We need to announce that we are in executive session having a discussion with legal counsel, the consultation with attorney under the open meetings act. So we'll continue that discussion. And number 59, consider appeal by elbert.
>> > we have just returned from executive session where we discussed the following items. Number 52 regarding the county clerk lease space. I move that we authorize facilities to go ahead and lease the space in question at 209 west ninth street for the county clerk's election equipment. That we authorize the county judge to execute the lease on behalf of Travis County. That we authorize the use of the lease savings and that at our next meeting we identify the source of funding for the difference in funding that we need.

Number 54, no action required today. That will be back on next week also. 55 involves the right-of-way settlement offer for property located on grand avenue parkway in precinct 2.
>> judge, I move the approval of the right-of-way settlement offer that's been presented to Travis County and to authorize me as the commissioner in question to sign any and all appropriate documents related to this settlement.

>> any more discussion? All in favor? That passes by unanimous vote. We did 56 earlier. Number 57 involving the lowther and nowlin case. I move that we approve settlement of this matter in the amount of $16,000 as recommended by our representative at mediation and the county attorney's office and we authorize the county judge to sign on behalf of Travis County. Any more discussion? All in favor? That passes by unanimous vote. 58, no action required today. We'll have that back on next Monday. For appropriate follow-up action as well as 59, the grievance panel of mr. Walker. We do need commissioner Gomez here to take action on that matter. We discussed number 40, but no action is required today. That will be back on next Monday. For appropriate follow-up action also. And then we discussed item number 9, which is the application to incorporate the community of volente. As Travis County judge, I find that the application that was filed with Travis County met all legal requirements and that as county judge I will sign and an appropriate order later today that I can make available to those who wish to receive a copy of the order of calling for an election on February first, 2003. And the written order will contain other specifics that are necessary and appropriate. We decided that the county judge should take this action today rather than the entire cmissioner's court if that would simplify matters and supply comply with the lawfully. And I will have copies of this available in my office in five minutes. There being no business today?
