Number 8 is to receive and consider reports from county staff on the petition to incorporate the community of webberville as a type c general law municipality and related attachments and take appropriate action. We did receive the report as part of the public heang. So we will simply pick that up as part of item number 8 also. In addition, we have a memo dated December 16th, 2002, from joseph p. Geiselman, executive manager, signed by carol joseph for him. And you are familiar with the content of that.
>> yes, we prepared that.
>> okay. And as staff at t.n.r., You worked on this matter?
>> yes. And we did verify that they do meet the requirements of the territorial regulations as well as the population.
>> so they meet all the standards that we require.
>> yes, sir, for those two items.
>> for those two items.
>> I was just noticing looking at the map, judge, and this is another waterfront city that's got a boundary that runs along the colorado river. I just wanted to point that out because I know the last time this was up somebody said do you have any waterfront boundaries and I think somebody said no, but I think they were thinking about the lake, but that's on the colorado, so just f.y.i. Do you know what assumption they used on that boundary call for the colorado?
>> no, I don't, but we can ask our surveyor, who is available in the other room.
>> eric did find it was under two square miles, though.
>> yes, he did. It was verified.
>> well, the letter that I referenced left me with the impression there are no issues.
>> exactly.
>> therefore I move that we receive staff's recommendation.

>> we need a separate posting to do that, so we'll have that on the court's agenda next week to call any elections.
>> I second that, judge. And --

>> take appropriate action. > do we need to call the election today? Undertake appropriate action, I think the wording is broad enough if we need to.
>> well, just a second, judge. Actually, judge, you are the one that calls the incorporation election.

>> do we need to do it today?
>> yes, we need to do it today, but what I'm saying is that the judge orders the incorporation election.
>> I understand.
>> okay.
>> I'm going to sign the order, but I'm making a motion to call the election I guess on February 1.
>> yes.
>> is that the date? Is that appropriate? I was left with the impression we would call the election on this one next week. But I don't know that there is any reason to wait if we can do it today.
>> the deadline for calling the election is the 17th.
>> as in today.
>> today is the 17th.
>> I move that we receive the recommendation of staff, which is basically that legal requirements have been met and that the county judge on behalf of the commissioners court call an election for the incorporation of the village of -- or the community of webberville for February 1st, 2003.
>> second that again.
