That's under the consultation with attorney and the personnel matters exceptions to the open meetings act, also. We will discuss these matters in executive session. But return to open court before taking any action.
>> judge did you call 13 b related to the contract award?
>> hold on, hold on, hold on. 13 wb -- 13 b related to the contract reward of the new precinct office building to hutchinson construction incorporated low bidder. We indicated this morning we had questions of council. That will be the consultation with attorney exception to the open meetings act. Again we will discuss these matters in open session, but return to open court before taking any action. We have just returned from executive session where we discussed the following item, number 13, we did get legal advice from the county attorney's office and based on that advice I move that we approve a contract award to the low bidder on this project to hutch inson construction incorporated.
>> second.
>> anymore discussion? All in favor. That passes by unanimous vote of those present. Show commissioners -- yes.
>> I think I know what it already is, and that is for the base bid and for all the alternates related to the award of the bid?
>> judge, in the morning you asked if the county furnished the cicd furnitures. Under the authority under the court of criminal procedure, I get this from jim rust. It says that the county served by cscd, minimal equipment for cscd each community supervision officer shall be furnished adequate furniture, telephone, an other equipment as necessary and consistent with efficient operation. So we have to provide furniture for cscd.
>> is that a draft contract that the court signed?
>> construction order.
>> the motion includes the base bid and bid alternates.
>> that's right.
>> and the furniture, addition to the furniture, change in the budget.
>> and...
>> and then 66,000.
>> yeah, it's the -- the base pay plus 5 --
>> hold on. Be set forth in a written contract at some point?
>> correct.
>> it will be brought back to us for approval?
>> yes.
>> okay. When they come back, we will double check all of that. See what I'm saying? There's not a written contract now covering all of this; right?
>> the alternate, I don't think so.
>> the alternate needs to be added to the contract. Even if the contract exists now it's got to be modified.
>> yes, sir, the ff and e is separate from the contract that you're going to award. It's more of a budget related issue. If you approve the budget that has been presented today, that includes the the advice.
>> again...
>> it's not for us to approve budget.
>> we can bring that back.
>> it will all be okay, y'all.
>> we can bring it back.
>> written document, evidence all it is that we execute anyway.
>> okay. All in favor. That passes by unanimous vote. Commissioners Gomez and Davis absent for the rest of this meeting.
>> just making sure we understand, judge, that is the approval of the contract award base plus the alternates and facilities and all appropriate people need to bring back the appropriate changes to the budget related to ff and e on a future agenda item.
>> what the agenda item asks for and that is to award the contract.
>> okay. Got you.
>> involving the county clerk elections, provision to move that we authorize facilities to work with appropriate brokers to identify appropriate buildings already constructed available for sale to the county clerk and try to bring back to the court a list of such properties after that period, that in the meantime facilities works with the county clerk to put in place an interim strategy to address all equipment needs starting the availability of additional space at 11th -- no, 9th and lavaca where we currently lease some space from the owner. And to do other steps necessary to achieve these two project.
>> yes. Second.
>> second by commissioner Sonleitner. The other step is intended to cover what other specifics we can fit under those two categories. All in favor? That passes by unanimous vote. And those will be reverted back to us for specifics before any direct action is taken. Number 31 involves the precinct 3 and constable precinct 3 office space. We did give directions to staff. I don't know that anything in addition is necessary today. I think I was told that it will probably take two weeks to get that done and come back to us, so we'll have this done in two weeks. Okay? If you will let her know that. It's an urgent matter. Based on the health concerns of county employees at that location. 32 involves 1622 east riverside drive. The county attorney's office and facilities will continue to work with the owner of that property. Anything needed today?
>> just to make it very clear whatever offer is out there from this owner that we need it in writing with the idea that whatever solution is being proposed must be expedited with very specific contractual solutions and dates identified for the county.
>> the urgency of this matter in our view. We will have this back on next week, hopefully with something to act on. 33 involves the security matters. We did not discuss this item as commissioner Davis had to leave. We will discuss this with staff next week. The county treasurer sent a letter out. Did y'all get a copy of that, to the court?
>> yeah.
>> we'll get you a copy of that because did raise some concern about this back door in the alley that I hadn't thought about a whole lot but I do think we ought to look at that. I think we ought to have a security task force in place for this building to kind of take a look at it and maybe from a law enforcement perspective as well as facilities and if that can get done between now and next week that will help us expedite that, I think. The next one that will be set to next week. Number 35, I move that we make an offer of judgment in this case for the amount of $25,000, that we further designate commission daugherty...
>> [inaudible]
>> attorneys fees and costs.
>> yes, sir.
>> second. > that do it. Anymore discussion? That passes by union vote. We did not discuss that item. It will be postponed until next week. 37 is a long list of resale deeds. Can we take all of these in one motion, you think?
>> sure, a, that amount, b, that amount.
>> in a, there is a resale dead to james bumpous in the amount of $22,510 that we have in hand already. In b there's a resale deed to carol anne chancellor in exchange for the amount of $5,000 in cash which she has delivered to Travis County. In c, there is a tax resale deed to walter wendlandt, in exchange for the amount of $6,000 that he has paid to us in cash. In d, there is a resale deed to miguel morales for the amount of $5,850 in cash that he has delivered to Travis County. In e under 37 there's a resale deed to vicki merriweather for the amount of $13,495 that she has delivered to Travis County. In f, there's a resale deed to monica green for $7,500 that she has delivered to Travis County. F there,' a resale deed to -- that was f right there, monica green. G is a resale deed to tony cernosek for the $3,000 that he has already paid to us and g is a resale deed to amp limited partnership for $13,932.77 that he has delivered to us also. In addition to approval of these, I move that we authorize the county judge to sign on behalf of Travis County.
>> second.
>> any questions? Discussion? All in favor? That passes by unanimous vote. Number 38 that involve, no action required today and it will be back on the agenda probably in two weeks. Should we get reposted and reset this two weeks? It will be back on 12-10? 39, the request for an extended administrative leave. I move that we authorize extending the administrative leave with pay, an additional ten working day, which should get us through December 15th.
>> second.
>> anymore discussion? All in favor? That passes by unanimous vote. Number 40, move that we authorize the precinct five constable to add the two administrative leave with pay days to the leave already granted and I think he's already indicated the specific days that he needs that for.
>> second.
>> all in favor? That passes by unanimous vote. Number 41 we postponed due to time constraints. We did indicate to the grievant that we will take this up at 11:00, a time certain next Tuesday, and give ourselves a full hour to discuss this matter. There being no further business today --
>> we need to make it clear on melissa on item number 30 (b), we weren't doing anything on that, it was just a that we were acting on.
>> sounds good to me.
