Discuss, approve or take any appropriate action regarding real estate issues for the Travis County pleasant valley road office building. That's the real property exception to the open meetings act. That's under 551.071, consultation with attorney exception, also. Building. 2 28. Consider request from Travis County judges regarding workplace safety issues at 1622 e. Riverside drive, Austin, Texas, and take appropriate action. That's the consultation with attorney exception to the open meetings act and real property exceptions to the open meetings act. 29. Discuss, approve or take any appropriate action regarding the lease space for justice of the peace precinct 3 and constable precinct 3. That's the real property exception to the open meetings act. Item number 28, we did discuss this one and concluded that further steps needed to be taken and back on the court's agenda next Tuesday, November 19th. Number 29 involves the precinct 3 and constable precinct 3 office building.
>> move that facilities be authorized to begin negotiations to try and get the best deal possible on suitable space for the jp and constable? Precinct 3, working within budgeted amounts with flexibility related to lease savings that can be identified by facilities.

>> and we'll have it back on. Any more discussion of the motion? All in favor? That passes by unanimous vote. Number 30 involves the request for waiver of penalties and interest from mr. Richard balderrama.
>> I would move that an appropriate letter be drafted on the signature of the county attorney informing mr. Balderrama that this case was taken to the commissioners court and presented but it is the conclusion of this court that no waiver of the penalty and interest be granted, and that we do not have issue with the tax collector working out an appropriate payment plan according to what she deems is appropriate for this particular case.

>> and I would add that after looking at the facts and consulting with the county attorney's office, we do not find to grant the requested waiver.

>> any more discussion? All in favor? That passes by unanimous vote. Item number 31 involving the abatement case against keith schoeffler at 2305 spring wagon lane. I move that we authorize the county attorney's office to assess costs in the total amount of $754.04. That would include any administrative expenses we're entitled to, costs, and further authorize the county attorney's office to pursue any action necessary to secure reimbursement of this amount to Travis County.

>> any more discussion? Which means filing a lien, filing suit, any other thing authorized by law.

>> all in favor? That passes by unanimous vote. Number 32 involving the nuisance abatement matter at 6200 fm #- 973 north. Move we authorize the county attorney to assess costs in the total amount of $23,404.04 and move that any legal steps necessary to obtain full ream barsment of this money to Travis County.

>> any more discussion? All in favor? That passes by unanimous vote. Number 33 involves a class action lawsuit against federal express for alleged two percent fuel surcharge. Move that we authorize the county attorney's office to contact all parties pursuant to the notice by the attorney in the class action lawsuit. If we have claims to pursue, encourage that each county department to submit the evidence of the claim to the county attorney's office by a deadline sufficiently short of the lawsuit deadline for us to file whatever claims we have.

>> any more discussion? All in favor? That passes by unanimous vote. We decided to postpone 34 in response to the county attorney's request until next week, November 19th, 2002. November 36 involves the action regarding moses h. Rodriguez junior, a county employee. Move that we authorize the county attorney to draw up that appropriate agreement accepting the terms and conditions that they have been discussing with mr. Rodriguez, which includes immediate payment of $5,000, and payroll period payments of $197.80 each -- 08 cents each until the additional sum of $9,056 has been paid. That we obtain the necessary promissory note to back up the agreement.

>> any more discussion? And authorize the county attorney to take any other appropriate action to secure this matter. In 36. All in favor? That passes by unanimous vote.
