Number one is to discuss the vacation of two drainage easements, a drainage and right-of-way easement, and two (2) public utility easements on the tract known as elm creek in precinct 1.

Initially when this -- this plat came in, it was -- came in as a -- as a site plan and the -- the permit had four or five acres initially to do some -- some subdividing and that they got an exemption, from the subdivision rules. And then didn't use the permit, didn't subdivide and now have since sold the five acres plus another 120 some oaks together. As a result they need to do away with the easements of setting aside initially with the five acres, that's what these are doing, this -- this public hearing is for, to do with those drainage easements and the public utility easements. To allow the new ownner to be able to come in and replat the entire subdivision.

It was a minor change that tom pointed out that -- that in the order that -- that judge Biscoe is supposed to sign. Now, therefore, we will get that changed to you before the end of today.
