A 2 is a public hearing to discuss an order to authorize the filing of an instrument to vacate a portion of the drainage easement across lot 28, lot b. [inaudible] estates, section 3, a subdivision in precinct 3.

>> one of these has never been voted down, but you never know. [ laughter ] just trying to hurry us up out of here. Applicant engineer has requested a vacation of the portion of the easement. As far as we are concerned everything is fine, we have no complaints.
>> anybody here to give testimony at this public hearing? Yes, sir, please come forward.
>> [inaudible], my name is gary [inaudible] we are representing a group of people trying to represent a group that wants to put a hitting. The conservation district might in some way remove that as a possibility? We are attempting to put a route from mansfield dam state park to the end of hudson bend peninsula. Again I haven't put one through here, but I'm a little confused as to exactly what this means in terms of the drainage easement. Again the map that was sent to me was -- was -- I had a hard time deciphering exactly what it meant. What is the draim easement used for? What is it there for? Is it to contain the 100 year floodplain, in the bottom of a ravine there, I believe.
>> [inaudible] generally want the we are to drain through and they are [inaudible] in a portion of it.
>> can I clarify that.
>> yes.

>> my name is [inaudible] representing this project. This particular drainage easement was dedicated prior to the time that we did our revised preliminary. It was done to -- let me get my glasses on right now. But there was a short form here, a short form here. The purpose of these separate instrument drainage and conservation easements was to provide conveyance of 100 year from these two short form plats because they were done prior to the revised preliminary for this portion. We had not done full drainage studies at that time and as it turned out, the 100 year floodplain came ahonk here and then dropped -- came along here, then dropped down. It's hard to see on this particular map.
>> that's the only one that I have.
>> well, while I all work that, I need to announce we need to give you 10 or 15 minutes to go into the executive session room.
>> I may just needed indicated.
>> we may have give you 10 or 15 minutes to get that education in one of these rooms. Carol just wave your handled, when you come back in, we will take it, okay. The executive session room should be right through that door straight ahead. And it should be empty.
>> do we need a motion to recess this so they can come back and say whatever they want to say.
>> I was simply going to not take any action, but indicate our attention to call it back up at the first sign of a -- sign to call it back up. If that's all right. That will give us a chance to get a couple more items done. We will call up a 2 the public hearing. Again we do need to recess since it's a public hearing.

>> until ms. Joseph indicates that she's ready, we expect that to be within the next 10 or 15 minutes. All in favor. That passes by unanimous vote.
