A 1 to discuss an authorization of the filing of an instrument to vacate the five foot public utility easement between lots 1 and 2, either side of the common lot line, of la hacienda estates section 2, a subdivision in precinct 3.

>> carol joseph, t.n.r. Initially this lot, the septic was failing and the owner owns both -- both the -- where -- the whole -- the mobile home is as well as the lot below. The lot below is flatter and they wanted to be able to vacate -- they wanted us to vacate that so they could put their septic in there and allow it to not fail. They had cited them before. That's why they are asking to vacate that utility easement to allow them to put the septic in the area where it's flatter and allow the septic to work. We have had one company, from a neighborhood, that -- that just really doesn't want a mobile home in the neighborhood. That's [inaudible]

>> my name is gary pacely, I live in the hudson bend area, represent a group trying to put a hike and bike trail out there. I guess the sign caut my eye and I got the map and I noticed that the vacation of easement intersects the lcra power line easement. And we are attempting to use the lcra power line easement as a potential route for the hike and bike trail. So I guess my question is if the vacation of utility easement intersects the lcra easement, does that remove public use of the [inaudible]?
>> doesn't look like it to me.

>> the way this is drawn, they have left five feet for access along the lcra easement, which doesn't --
>> all that's being vacated is the platting of the public utility easement. The lays lays's easement stands alone completely. It wasn't completed by the plat.

>> my name is pamela benson, I'm the opener of the property there. To address your concern -- the owner of the property there. To add your concern, I don't believe it will affect what you want to do through the lcra easement, we have gotten a letter of consent from them to build underneath there with concessions involved. So I don't think it should be a problem.

>> but I will be happy to work with you on that. Sure. On the pue easement that we want vacation, I'm sorry that my neighborhood doesn't want us to be next door. We have been trying to comply with everything. Unfortunately I think part of the problem has been with my neighborhood is -- is the slow process with which we can move that part of -- of the septic system. The septic system is only two years old. Unfortunately, part of the irrigation field that we put in was in the wrong place and it didn't adequately drain. It's a -- it's an evaporation system. So we have immediately tried to assess the problem and then tried to work with it, even to the point of removing six of our tenants so that it didn't over burden the system. So -- so I feel like we have been trying to do everything possible to -- to accommodate their situation. And particularly ours so that we can get a functioning septic system. This is the last step. So that we can get construction going.
