Agenda Item A1

video.
>> [inaudible] find out whether the -- or the j.p. Plan to
come down on a-1?
>> it doesn't sound like it.
>> a-1 is kind of budget related which is why I -- a-1, discuss
amended order setting fees to be charged for services by the sheriffs and
constables in 2003. And take appropriate action.
>> judge, commissioners, the order you previously considered
has revised the amount for certain services by the sheriff and constables.
Just last week there was a discussion between constables offices with the
offices of the justice of the peace, and one of the justices of the peace
indicated that a couple of these items need to be tied together, and that's
basically what the statute ties them together. And that was not done in the
previous order to consider. So the writ of reentry, which is -- which had
previously been less than $130, needs to be bumped up to the $130 amount of
the writ of possession. Those have to be tied together under the statute.
>> so instead of being $95 as we approved, it ought to be
$130?
>> right. Those two need to be the same. In addition, there's
a property code show cause order, b, which is tied to the citation fee, and
that probably needs to be added in there just to distinguish that from any
other show cause order that a court is going to charge. So this is expressly
set out in the statute as the fee to be charged for services by the constable
or sheriff in the [inaudible] order under your schedule.
>> so the two changes are to change the writ of reentry to
130?
>> right.
>> and the --
>> and add the property code show cause order.
>> it now says $50?
>> right.
>> the property code?
>> right.
>> move approval of those two changes.
>> second.
>> any more discussion? That will get it done for us. Execution
of this order. Will this be an amended order or an order?
>> let's just call it an order. Just redoing it.
>> order in all caps.
>> okay.
>> it replaces the previous order.
>> that's fine with me. Any more discussion? All in favor?
That passes by unanimous vote. Thank you very much.
>> thank you.
