Item number 1 is a public hearing to receive comments regarding the sale of county property located at 13133 volente road, austin, texas, f.m. 2769 in presing three under terms of the texas parks and wildlife code, chapter 26 public hearing process.

>> good morning. Rose farmer. We are interested in selling a property on volente road that was acquired in 2006 by travis county, and the property has 3.1 acres of land, which is 3,200 -- more than 3,000 square foot house and two and a half acres of land around it plus a .6-acre driveway. The property was acquired to reduce an inholding for the balcones canyon lands preserve to give us an access easement to that portion of the preserve chfts very difficult for us -- which was very difficult for us to reach. At this point we find that there is no use for the house for bccp purposes and we would like to sell the house portion, but retain a conservation easement on 1.5 acres of land around the house. And also keep the access road easement to provide a way for our staff to get to that portion of the preserve.

>> have we received any objections to the proposal?

>> we have not.

>> would anyone like to give public hearing. If so, please come forward. Yesterday i sent staff and legal a concern i had. This code requires that we make specific findings in three areas.

>> that's correct.

>> so my question was whether a simple motion that we have reached that conclusion would constitute a finding. My purpose would be not to. My purpose would be for us to approve a document that contains findings, so five years from now after we've all moved on down the road, if somebody wonders what has happened, instead of being a motion, it would be a resolution or something containing findings. When i read that it seemed to me we were supposed to make findings of fact to support the conclusions that we reach.

>> so if you would -- if you would like us to create a document that is a resolution document that makes those statements, we would be happy to do that, judge.

>> i would rather than a simple motion. I mean, the more i thought about it, the more convinced i am that we're supposed to make findings.

>> okay.

>> maybe have the findings between now and the end of this meeting. I'm talking about a one pager.

>> we can get that ready for this afternoon if that's something that we're still able to do today.

>> i saw the e-mail exchange with legal on that. And i don't remember if y'all were ceepped or not. They my indeed have a resolution in the process.

>> hopefully. I think i sent it to mr. Gieselman. And anyway, we can certainly end the public hearing. That's item 18, which in my view we should hold up on until we have a document that contains those findings. So really the facts that i read in the backup support our conclusions.

>> yes.

>> it's just that that would be an incredibly long negotiation moation for us to put those those in the motion.

>> move the public hearing be closed.

>> second.

>> all in favor? That passes by unanimous vote. Let's indicate our intention to call up 18 toward the end of the medina county, okay?
