A 1 is to consider and take appropriate action on request to temporarily close allen road from pinnacle road to easy street in precinct 3 for construction of 16-inch water lines and a pumping station beginning june 23rd, 2010 and continuing for 100 days through september 30th, 2010.

>> good morning, commissioners, judge, i am david gear, t.n.r. Traffic engineering, we had this on last week for a public hearing and -- and since then we have all met with all of the parties and discussed some of the issues that we would like to take care of. But we have come to a consensus and we agree with a 100 day closure. If you would like, i can go through some of those items that we have discussed and agreed upon.

>> we did get the backup. How do we secure the commitment or commitments that the compromise entails?

>> a lot of that will be with the project managers atmosphere the city of austin working with the contractor -- at the city of austin working with the contractor. They are here as well, maybe i could refer that to them.

>> okay. There are a lot of commitments here, i guess my question is how do we enforce them?

>> good morning, judge. Commissioners.

>> good morning.

>> i'm larry mendez, the project manager for the city of austin for this allen road project. We have a couple of items that i can assure this. One of them is our contract is -- has liquidated damages up to 300 days to complete work. The project itself. As far as the water items, we will have contractors out there with the -- with the -- with the daily meetings, weekly meeting progress, keeping up with the progress, assuring you that a lot of times you guys give us, we will complete this work in this allotted time. We've also had consensus with the neighborhood associations, the eanes school district, contractor, all of these people have agreed to this allotted time. Once we did agree to, once we get started, closer to when school begins, we have owe owl we will have traffic officers monitoring the traffic and making sure that -- that closures are secured.

>> you are satisfied that that's sufficient?

>> yes.

>> you are.

>> janet atkinson from the austin water utility.

>> okay.

>> and.

>> residents were at the meeting to discuss this issue.

>> eanes i.s.d. As well.

>> and residents are satisfied with the result?

>> yes, yeah, we all came together and agreed, there were other smaller items like allowing contractors to work on saturdays if need be, things like that. There were some things that the county will take care of as well, with -- with some -- some replacement of no parking signs, which we will take care of as well. And working with the sheriff's department for increased enforcement of no parking.

>> so should we accept this -- this one pager into the record? And i guess when we approve the compromise, make sure that this is part of it.

>> i would say yes, yes.

>> judge, i have a question.

>> commissioner?

>> i had received a communication from some of the neighborhoods since last week, they were quite happy with what they understood the discussions to be. But asked that i clarify for the record one part of their understanding and that's related to -- to the -- to the traffic control at the intersection of camp craft and west bank. That that will occur for four hours each day, between the time frame of august 25th, i mean, 24th, 2010 and september 30th, 2010. And -- and one of the -- and that the city -- they understood that the city of austin to have an agreement with the construction company pursuant to that. Is that correct?

>> we're going to ask the contractor to -- to get a proposal from -- from any enforcement office to monitor the traffic during the -- during the school time. When school is open and then closing. So it will be -- the contractor's responsibility to get an officer out there to direct the traffic during school. Yes, sir.

>> okay. And then in addition, pursuant to that, they were wanting to confirm that that traffic monitoring time would be between 7:00 a.m. And 9:00 a.m. And 3:00 p.m. To 4:00 p.m. They understood that there was just four hours a day designated and they were interested in seeing that the time frames were -- were -- understood as well.

>> that's when the schools open and closing, so we're going to make sure that there will be officers out there during those times, yes.

>> all righty, thank you.

>> okay, 7:00 to 8:00 and 3:00 to 4:00 is two hours.

>> 7 to 9. Did i say 8.

>> and 3 to -- 3 to 5.

>> that's part of the agreement?

>> yes, sir.

>> okay.

>> move approval.

>> second.

>> discussion of the motion? All in favor? That passes by unanimous vote. Thank you all very much. Appreciate your work on this issue. Ms. Moffett, are you nearby?
