Item 6

>> number 6, consider and take appropriate action on the proposed sale to the lower colorado river authority transmission services corporation of two electric line easements on, over and across property owned by travis county near onion creek and state highway 71 east.

>> judge, i failed to ask staff this question during the public hearing, but it's something that came up, and that is since this is parkland, and, of course, since it will be used by the general public, my concern was what type of safety measures are in place to alert persons that use the park? That here is a transmission line that's covering this area, be aware, you know, da, da, da. What circumstances make it not hazardous?

>> we've actually master planned the park in such a way that the easement will be in a buffer that we are legally obligated to not develop as part of parkland. When with acquired the property we did a buffer setback with the adjoining property. We do not plan any recreational activities within that buffer. And that is where the electrical line will be. It will be fenced off. And at a distance from any other park activities. So i'm pretty sure that we've looked into even fishing where a person would, you know, cast a line and be far enough away from the line not to have any interference with the line at all. It will be clearly visible because it's a high-powered line with fairly large structure to it, but it will be out of the area where that we're going to be using for park activities.

>> okay. That's what i wanted the public to hear what your staff and what your department has done to safeguard the public health and safety of any resident that uses our park systems. So i just wanted to hear that public disclosure of what you and your staff have in place. Thank you.

>> we were just handed a one-pager. So if we approve this, you would like the court to read into the record these two items?

>> yes,

>> [indiscernible] make these findings under chapter 26 of the parks and wildlife code. And if you are satisfied that -- that the court -- that there is no other prudent alternative and that all other safety measures have been taken, then you can make these findings pursuant to the information you have been given today.

>> okay. Has joe seen these?

>> yes, i have.

>> that's what you and the staff told us during the public hearing, right, these two points?

>> right.

>> any other questions, comments?

>> we're then incorporating these two as required by chapter 26 and i would move approval of 6.

>> do we need to put these in an order or something?

>> i can draft an order for you, but it would be sufficiently legal -- it would be legally sufficient to read these two findings into the record which you so choose, which i would be happy to prepare a written order if you would prefer.

>> we just take this and sign it at the bottom.

>> we can do that.

>> instead of my reading it into the record.

>> i can just add signature lines to it to make it look nicer and bring it back down to you if that would be okay.

>> okay.

>> that way on payday i'll feel real good when i see you go get your check.

>> thanks, judge.

>> any more discussion? All in favor? That passes by unanimous vote.
