consider and take appropriate action on request to use parking lot and comfort facilities at palm school on July 4, 2009 from 4:00 p.m.
to 8:00 p.m.
>> Commissioner Davis?
>> yes, judge, I just had one question.
i guess it was basically for legal.
and that is about allowing the parking lot and the other -- the use of that facility like restrooms and things of that nature.
would that pose any liability for the county?
>> who is going to be using it?
is it a group or --
>> well, the neighborhood I guess.
the neighborhood group.
>> ordinarily we do a license agreement.
we have an agreement that we use for use of parking lots and parking facilities.
that covers the liability issue.
if you can send me additional information --
>> we will take this up in executive session today.
john hilly was part of the discussion.
>> I'm not aware of that, he's not here today.
>> yeah.
>> okay.
he's out of town.
i asked him whether a license agreement would be necessary.
>> well, I called john hilly yesterday, he wasn't available.
>> he's out this week.
>> I know that I have done a license for using a -- the palm square parking lot.
we did the -- we did the environmental -- people turned in their computers and we had agencies that picked those up and disposed of them.
we did an agreement with those agencies, so -- I can check with tinley, too, this is more her area.
whatever john told you I'm sure --
>> the thing is that the parking lot is open when the county building is closed anyway.
so if you want to just drive in there and park you can.
there are a couple of other things that we are authorizing at this time, like use of the restrooms between 4:00 and 8:00.
>> in the building.
but -- but whatever lawyer wants to advise us, we will call it up in executive session.
>> I will try to get somebody to answer your questions.
>> any questions for the neighborhood association?
>> no, just that legal question that I wanted to pose because I did call john hilly's office, his recording said he's out on vacation.
so I didn't -- couldn't get a legal response.
i know he normally deals with that.
>> okay.
we'll have to discuss it with legal counsel in executive session whenever we reach it today.
so -- so -- we'll just phone in, let you know.
