13. Consider and take appropriate action on a variance request to install the supply and return line to the treatment units closer than five feet to public utility easement and house foundation at 306 bulian lane. I had a simple question as I read that. It seemed that the request of the recommended action made all of the sense in the world, but I wondered if there is a problem with this in the future, what potential legal liability does Travis County have because we are placing these lines much closer to -- to the utility easement and foundation and pool than we normally would, right?

>> let me revise the staff recommendation. We -- we recommend granting this variance on the condition that the -- that the homeowners indemnify and lease the county -- release the county any liability from having those return lines closer to the public utility easement

>> [indiscernible] than the required setback.

>> well, that certainly addresses the county judge's concerns.

>> so we're just going to get them to sign an indem indication agreement.

>> yeah. Here's where the rules are kind of silly because you can put a drip emitter line right up to the public utility easement but you can't put a solid supply line within five foot. So it's kind of a silly thing, but -- but we will ask the owners to -- before we grant the permit to indemnify and release the county.

>> that would be fair to me because I -- as I visualize this project, I cringed a little bit. But -- but got to cover me.

>> move approval.

>> the owner really doesn't have a whole lot of choice I take it.

>> it's an existing home.

>> any more discussion? All in favor? That passes by unanimous vote. Thank you all very much.
