15 is to consider and take appropriate action on the following: a, interlocal agreement with the del valle independent school district for improvements to fm 9 sciep and fm 1327. B is to advance funding agreement with the Texas department of transportation for improvements to fm 1327. And c is amendment number 1 to the advanced funding agreement with the Texas department of transportation for improvements to fm 969.
>> I understand you have all the originals, is that correct?
>> they kale this morning.
>> -- they came this morning.
>> we are a pass-through between the school district and the state of Texas. And I don't know why txdot cannot contract directly with the school district, but we're in a position of basically taking the money from the school district, turning it around and giving it to txdot. So that txdot can construct improvements to the state highway system on behalf of the school district. And all we are is passing it through. That's all -- we're guaranteeing that the school district fulfills our obligations to the state under the advanced funding agreement. And that the money is about $480,000 that's being passed through from the school district to the state.
>> there's more than 1100 school districts and there's only 254 counties.
>> maybe that's it.
>> we do get to keep the interest if we have it in our position about 60 days, don't we?
>> no. I think it actually accrues to the account. Most of our fwreaments we -- of our agreements would have the interest go towards the project if it accrues.
>> you'd make a good banker, joe.
>> we might consider charging a service fee for this, but we don't right now.
>> move approval of item 15.
>> second.
>> discussion?
>> yeah. I'd just like to point out that do we know where txdot is on maybe doing direct business with the school district or anybody else instead of using counties for this advanced funding agreement where we just accept the money as a go-between with the school district and also txdot? Do we know where they are on that? Has anybody visited? Because if it's something that we feel uncomfortable about, that's a policy and I guess it's state statute, is there anything that gets -- that bob day and anybody else can do with tnr?
>> I’m not even sure whether or not it's state law or it's txdot administrative policy that requires the county or the city to be the contract agency. It's just txdot's preference that it be one of the local governments instead of a private interest or a school district.
>> so is it policy or law?
>> I do not know. I do not know.
>> Commissioner, to my knowledge, it's policy. We've never been able to find any sort of statutory basis for it.
>> so we don't really have to do it unless we want to. It's policy by txdot, but we carnt subject to txdot policy, are we?
>> the position it puts you in is if you're not willing to step forward and serve as the pass-through, then in this case the school district doesn't get the improvements built, then the typical case as a subdivision developer, if you don't step up and saying we're willing to serve as the pass-through, he doesn't get the road improvements he needs to give his subdivision a safe entrance.
>> and my question is why it's not directly to the school district? That's my first point.
>> as best I can tell, it's because it's always the way they've done it. One of those deals.
>> now, we have come to executive session. [ laughter ]
>> have we voted yet?
>> all in favor? That passes by unanimous vote.
